1. Acceptance of Terms

 

By accessing or using The Gym Faction app or website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our app or website.

 

2. Eligibility

 

You must be at least 18 years old to use The Gym Faction app or website. By using our services, you confirm that you meet this age requirement.

 

3. User Accounts

 

• Account Registration: To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account information.

 

• Account Termination: We reserve the right to suspend or terminate your account if you violate any of these terms.

 

4. Membership and Subscriptions

By making a payment or subscribing to any plan on TheGymFaction, you agree to the following terms:

• Authorized Platforms:
  Payments are only valid when made directly through TheGymFaction's official mobile app, including via In-App Purchase within the App Store. Payments or subscriptions made through any other means are not recognized by us.
  
  
• Unauthorized Transactions:
  - TheGymFaction is not responsible for any losses incurred through transactions made on unauthorized platforms or via third-party requests.
  - We do not endorse or affiliate with any third-party payment services or links.
  
  
• Free Trial:
  New users get full access to all features of TheGymFaction for 1 day, free of charge. After the 1-day trial period ends, you will continue to have access to select free features, while detailed workouts and premium content require an active paid subscription plan. If you purchase a subscription before the free trial ends, any unused portion of the trial will be forfeited.
  
  

• Subscription Plans: Details of our membership and subscription plans, including fees, payment terms, and plan durations, are provided in the app and on our website.
  
  

• Auto-Renewable Subscriptions (App Store In-App Purchase): If you subscribe using In-App Purchase, payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan. You can manage or cancel auto-renewal at any time from your Account Settings in the App Store.
  
  

• Subscriptions Purchased Directly: If you subscribe directly through TheGymFaction outside of In-App Purchase, your subscription does not automatically renew. At the end of the subscription period, access to premium features will expire unless you purchase a new plan. You will not be charged automatically for renewal, and it is your responsibility to re-subscribe if you wish to continue using premium features.
  
  

• Payment and Billing: All payments must be made through the provided payment gateway. By providing your payment information, you authorize us to charge you for the membership plan you select.
  
  

• Refund Policy:
  Purchases made through In-App Purchase are billed and managed by Apple. Refund requests for these purchases must be submitted directly to Apple through your Apple ID account's purchase history and are subject to Apple's own refund policies. For subscriptions purchased directly through TheGymFaction, all purchases are final and non-refundable. We encourage you to make full use of the 1-Day Free Trial to evaluate the app before purchasing a plan.
  
  

• Disputes and Chargebacks:
  - In case of disputes, please contact us directly before initiating a chargeback with your payment provider.
  
  

• Account Responsibility:
  - Ensure your account credentials are secure to prevent unauthorized access to your subscription details.

 

5. Use of the App and Website

 

 

• Personal Use Only: The Gym Faction app and website are for personal use only. Commercial use is strictly prohibited.

 

• Prohibited Activities: You agree not to engage in any activity that could harm our app, website, or other users, including but not limited to hacking, data mining, and using bots.

 

6. Health and Safety Disclaimer

 

• Consult a Professional: You should consult a physician or other qualified health professional before starting any fitness program. The Gym Faction is not responsible for any injuries or health issues that may arise from using our app or following workout programs.

 

• User Responsibility: You are responsible for your own health and safety. Always exercise caution and listen to your body.

 

7. User-Generated Content

 

• Content Ownership: You retain ownership of any content you submit, post, or display on or through the app or website.

 

• License to Use Content: By submitting content, you grant The Gym Faction a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, reproduce, and distribute your content.

 

8. Intellectual Property

 

All content, trademarks, and data on The Gym Faction app and website are the property of The Gym Faction or its licensors and are protected by intellectual property laws. Unauthorized use is prohibited.

 

9. Limitation of Liability

 

To the maximum extent permitted by law, The Gym Faction shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

 

10. Indemnification

 

You agree to indemnify and hold harmless The Gym Faction, its affiliates, and its employees from any claims, damages, losses, liabilities, and expenses arising out of your use of the app or website, your violation of these Terms, or your violation of any rights of a third party.

 

11. Changes to Terms and Conditions

 

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the app or website. Your continued use of our services following such changes constitutes your acceptance of the new Terms and Conditions.

 

12. Governing Law

 

These Terms and Conditions are governed by the laws of the Indian government. Any disputes arising from these Terms will be resolved in the courts of the Indian government.
